Story Metro Terms of Use

1. Introduction and Acceptance of Terms
Welcome to Story Metro. These Terms of Use ("Terms") govern your access to and use of the Story Metro website, applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not use the Service.
Story Metro is a licensed subscription service for digital books and audiobooks. All content available on the platform is provided by authors, publishers, and other rights holders under written distribution agreements with Story Metro LLC, and is made available to subscribers for personal, non-commercial use only.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If changes are material, we will provide notice through the Service or via email with reasonable advance notice. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
2. Eligibility and Account Registration
2.1 Age Requirements
You must be at least 13 years old to use the Service. Users between the ages of 13 and 17 ("Minors") may only use the Service with verifiable parental or guardian consent, as required by the Children's Online Privacy Protection Act (COPPA) and other applicable laws. By creating an account on behalf of a Minor, a parent or guardian agrees to these Terms and accepts responsibility for the Minor's use of the Service.
Story Metro does not knowingly collect personal information from children under 13. If we become aware that a user under 13 has created an account without appropriate parental consent, we will promptly remove that account and associated data. 2.2 Account Information
By creating an account, you agree to:
- Provide accurate, current, and complete information
- Keep your account information up to date
- Maintain the confidentiality of your account credentials
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in behavior that harms the platform or its users.
3. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share information about you. By using the Service, you consent to the data practices described in the Privacy Policy. Our Privacy Policy is available at storymetro.com/privacy and is incorporated into these Terms by reference.
We comply with applicable privacy laws, including COPPA for users under 13, the California Consumer Privacy Act (CCPA) for California residents, and other applicable state and federal privacy regulations.
4. Subscriptions and Billing
4.1 Subscription Terms
Access to Story Metro requires an active subscription. Subscription pricing, features, and billing cycles may change from time to time. Any changes will be communicated through the Service or via email with reasonable advance notice.
Subscriptions automatically renew at the end of each billing period unless canceled prior to the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to the Service until that time.
4.2 Payment Processing
Payments are processed through third-party providers such as Stripe. By subscribing, you agree to their applicable terms and conditions. Story Metro does not store full payment card information. You are responsible for ensuring your payment information remains current and accurate.
4.3 Refund Policy
Except where required by applicable law, all payments are non-refundable. This includes situations where a user forgets to cancel before renewal, does not use the Service, or is dissatisfied with specific content available on the platform.
However, Story Metro may, at its sole discretion, issue refunds or credits in the following exceptional circumstances:
- Duplicate charges caused by a technical or billing error
- Charges made in error due to a platform malfunction
- Unauthorized charges resulting from a verified account compromise
- Other billing issues determined to be the result of Story Metro error
Refund requests must be submitted to support@storymetro.com within 30 days of the disputed charge. Refund decisions are made on a case-by-case basis and do not establish an ongoing obligation to provide refunds.
4.4 Disputed Charges and Chargebacks
If you have a concern about a charge, we strongly encourage you to contact us at support@storymetro.com before initiating a chargeback with your payment provider. We will make reasonable efforts to resolve billing disputes promptly.
If a payment is disputed or charged back, Story Metro reserves the right to suspend the associated account pending investigation. Repeated or fraudulent chargebacks may result in permanent termination of access. Nothing in this section is intended to limit any consumer rights you may have under applicable law.
5. Acceptable Use
You agree to use the Service only for lawful, personal, and non-commercial purposes. Prohibited activities include but are not limited to:
- Copying, reproducing, distributing, modifying, or creating derivative works from any platform content without permission
- Attempting to bypass or circumvent any security measures or access controls
- Scraping, crawling, or extracting data from the platform by automated means
- Interfering with or disrupting the operation of the Service or its servers
- Using the platform in any way that could harm Story Metro, its authors, or other users
- Sharing account credentials or allowing unauthorized parties to access your account
- Using the Service for any commercial purpose without prior written consent
Any violation of this section may result in immediate suspension or termination of your account.
6. Content and Intellectual Property
6.1 Platform Content
All content available on Story Metro is protected by applicable intellectual property laws. Authors retain ownership of their original content. Story Metro owns the platform, technology, branding, and overall Service infrastructure.
By using the Service, you are granted a limited, non-exclusive, non-transferable, revocable license to access and read content for personal, non-commercial use only. This license does not permit redistribution, resale, public display, or any other unauthorized use of content.
6.2 Clean Reads Content Standards
Story Metro curates content according to its "Clean Reads" standards. Content on the platform is intended to be free from the following:
- Explicit sexual content or graphic nudity
- Graphic violence or gore
- Excessive or gratuitous profanity
- Content that glorifies illegal activity, self-harm, or abuse
While we strive to maintain these standards, we do not guarantee that all content will meet every individual preference. We reserve the right to review, modify, remove, or restrict content at our sole discretion, including for policy violations, legal concerns, or platform integrity.
6.3 User Feedback
If you provide feedback, suggestions, or ideas to Story Metro, you grant us a perpetual, royalty-free, worldwide license to use that feedback without restriction or compensation. This allows us to improve the platform without ongoing obligations to you.
7. Account Termination and Data Access
You may stop using the Service at any time. Prior to closing your account or upon request, you may export or download your personal data (such as reading history and preferences) through your account settings, subject to technical availability.
We reserve the right to suspend or terminate your access at our discretion, with or without notice, if you violate these Terms or if your use of the Service poses a risk to the platform or its users. Upon termination, your right to access the Service and its content ends immediately.
Following account termination, we will handle your personal data in accordance with our Privacy Policy and applicable law.
8. Enforcement
We reserve the right to investigate violations of these Terms and take appropriate action, including suspending or terminating accounts, removing content, and cooperating with law enforcement where legally required or permitted. We may use platform data and activity logs to investigate misuse, fraud, or disputes in accordance with our Privacy Policy.
9. Disclaimers and Limitation of Liability
9.1 Warranty Disclaimer
The Service is provided on an "as is" and "as available" basis. Story Metro makes no warranties, express or implied, regarding the reliability, availability, accuracy, or suitability of the Service or its content. We do not guarantee uninterrupted access or that the Service will be free from errors, bugs, or security vulnerabilities.
9.2 Limitation of Liability
To the fullest extent permitted by applicable law, Story Metro and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of profits, or service interruptions, arising from your use of the Service.
Our total aggregate liability for any claim arising out of or related to the Service shall not exceed the total amount you paid to Story Metro in the twelve (12) months preceding the claim. Some jurisdictions do not allow limitation of certain warranties or damages, so some limitations above may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Story Metro, its founders, officers, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your infringement of any third-party rights; or (d) any content you submit or transmit through the Service.
11. Dispute Resolution and Governing Law
11.1 Informal Resolution
Before initiating any formal dispute, you agree to contact us at support@storymetro.com and attempt to resolve the matter informally. We will make reasonable efforts to respond and resolve disputes within 30 days of receiving your notice.
11.2 Binding Arbitration
If informal resolution is unsuccessful, any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by a recognized arbitration organization in the State of Utah, rather than in court, except where prohibited by applicable law. The arbitration will be conducted in English.
11.3 Class Action Waiver
You agree to waive any right to participate in class action lawsuits or class-wide arbitration. Claims may only be brought in an individual capacity. This waiver may not apply if prohibited by the laws of your jurisdiction.
11.4 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction of state and federal courts located in Utah.
11.5 Consumer Rights
Nothing in this Section is intended to limit any rights you may have under applicable consumer protection laws in your jurisdiction. If any provision of this Section is found unenforceable, the remaining provisions shall continue in full force and effect.
12. General Provisions
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Story Metro regarding your use of the Service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Story Metro may assign its rights and obligations under these Terms without restriction. You may not assign your rights under these Terms without our prior written consent.
